Council Member Letitia James Questions AY Modular Development At City Council Oversight Hearing
(New York, NY)— On Tuesday, January 22, 2013, at a New York City Council Housing Committee Oversight Hearing, Council Member Letitia James joined her colleagues, union-aligned contractors, and others in discussing modular building development. Modular or pre-fabricated construction refers to a building method in which building portions are constructed off-site (often in a factory). SHoP Architects have designed modular residential towers that should allow Atlantic Yards developer Forest City Ratner (FCR) to save considerable costs.
Council Member Letitia James, representing Brooklyn’s 35th Council District which houses Barclay’s Arena and the developing Atlantic Yards site, asserted that modular development has the risk of producing low-quality construction. For a comprehensive construction such as Atlantic Yards—where the 32-story modular residential tower currently in development will stand as the nation’s largest modular development—this constitutes an experiment that may not stand the test of time.
Recent media reports have stated that the steel panels that line Barclays Arena “have occasionally dripped rusty orange blossoms onto the sidewalk,” noting that “iron workers have replaced hundreds of bolts that anchor the panels to the building’s structure. Engineers determined that weaker ones were originally installed, raising concerns about the structure’s integrity.”
Representatives of the city’s Department of Buildings and FCR testified at the hearing that there were considerable benefits to high-rise modular construction, while union representatives argued that prefabricated (off-site) construction could permit the developer to work without the supervision of licensed plumbers, electricians, and other experts.
“I am deeply concerned that we are compromising safety for the bottom line,” said Council Member Letitia James.

ATTENTION: Energy Self-Certification For Sandy-Affected Buildings
Property Owner,
If your building was damaged by Hurricane Sandy, a licensed contractor must certify that your energy equipment has been repaired and inspected before Con Edison can reenergize your property. A simplified process for turn-on requests will speed service restoration to damaged buildings. This process is coordinated through the NYC Department of Buildings.
While Con Edison recovers from the storm, the city is allowing building owners to file a Self-Certification Form directly with utilities, to restore service faster.
Self-Certification is a three-step process:
1. Get your electrical equipment inspected, cleaned, repaired by a licensed electrician.
2. Direct your electrician to complete a Self Certification Form (Electrician-Inspection or Self Certification Form– Electrician-Repair0

ATTENTION: Post-Sandy Updates
The Office of Council Member Letitia James is available at the District Office at 67 Hanson Place, and has been assisting residents in emergency shelters, and facilitating fallen tree removal and other Hurricane Sandy-related issues. The District Office may be contacted at (718) 260-9191.

Con Ed/ Electricity
As of October 31, 2012, Con Edison was able to return service to many Manhattan and Brooklyn customers who have been without service since Hurricane Sandy touched down. If you are still without service, please report to 1-800-75-CONED. The Con Ed outage map is available here: http://apps.coned.com/stormcenter_external/default.html
Please be aware that the NYPD has set-up light towers in areas that continue to be without power.
Buildings
The Department of Buildings has begun inspecting buildings in Zone A areas to assess their structural integrity. By and large, these inspections are taking place outside of the 35th District.
However, please be aware that buildings will be tagged with one of three color placards to indicate their safety:
Green: the building is safe to enter
Red: the building is not safe and may not be entered
Yellow: it can be occupied conditionally (i.e. one floor may be safe while another is not.) These conditions would be explained on a placard attached to the building.
Transportation
As the MTA and New York City Transit recover, Governor Andrews Cuomo has announced that free transit will be available for Thursday (Nov 1) and Friday (Nov 2), and limited subway service will be available. WNYC has a helpful Transit Tracker available here: http://www.wnyc.org/articles/wnyc-news/2012/oct/28/transit-tracker/. Multiple outlets are reporting that the MTA-operated Brooklyn-Manhattan "bus bridge" is slow-moving, as is acquiring gas. Please be aware that cars entering Manhattan must have 3 passengers between the hours of 6:00AM to midnight. Roughly 4,000 taxis and livery cabs are available and allowed to do street hails and pick-up multiple fares. The city suggests an additional $10 charge per fare and notes that drivers must quote prices up front.
Schools
The Department of Education schools are closed Thursday (Nov 1) and Friday (Nov 2). Teachers and administrators are expected to report to work on Friday for updates.
CUNY is open on Friday (Nov 2), except: Borough of Manhattan Community College, College of Staten Island, Baruch College and Kingsborough Community College.
Sanitation
The Department of Sanitation is making scheduled garbage collections as conditions permit. Recycling collections are suspended at this time.

IDA will also waive all fees and look to streamline its normal procedure. This program is expected to offer economic benefits to reconstruction projects costing $500,000 or more. Finally, office space at Brooklyn Army Terminal is available free of charge. This space includes approximately 40,000 square feet of warehouse area.

(Brooklyn, NY)— Yesterday, a four-story building’s roof collapsed at the Fort Greene site of the developing Carlton Mews Townhouses at 227 Carlton Avenue. The roof collapse took the life of Mr. Winston Gillett, 67, a construction worker with TTNJ Community-Based Organization. Another worker, Mr. Clayton LaBoard, 43, remains hospitalized and in critical condition.
At this time, no relatives of Mr. Gillett have come forward. The Jamaican Consulate General has been contacted to assist in the search for family members. Mr. Gillett’s last known address was on Irving Avenue in the Bushwick section of Brooklyn.
“I urge anyone who recognizes Mr. Gillett to come forward so that we can provide closure to his family at this tragic time.” said Council Member Letitia James.

(Brooklyn, NY)— On Monday, September 10, 2012, a four-story building’s roof collapsed at the site of the developing Carlton Mew Townhouses at 227 Carlton Avenue. The roof collapse, which took place at around 9:15AM, severely injured two construction workers—one who was pronounced deceased at Brooklyn Hospital. Additionally, two other workers were busy on the roof at the time of the collapse.
The development at both 225 and 227 Carlton held Department of Building (DOB) permits for proposed two-family homes. A representative of the DOB clarified that there were no open complaints or violations on the development (although some media reports state the site has at least 1 violation). However, the New York Times reported that a neighbor recently called 311 to complain about excessive vibrations coming from the construction site; but they did not file a formal complaint with the City. Various media reports echo poor construction at the development site.
The Times also reports that other neighbors say they had noticed structural damage to their own homes since the construction started a few months ago.
“This tragic incident raises serious concerns about the safety practices at this construction site, and whether there was proper oversight of this construction by both the Department of Buildings and the developer,” said Council Member Letitia James. “I will be working closely with the Department to review the circumstances that led to this horrific incident. I believe this tragedy further underscores the need for greater safety precautions and worker safety training at major development sites throughout the City.”
The Carlton Mews Townhouses consist of five proposed townhouses along Carlton Avenue between Willoughby Avenue and Dekalb Avenue. The proposed completion date for the project was December 2012.

Illegal Billboard Fell Onto BQE; Highlights Need For Greater Regulation
(New York, NY)— On Friday, January 13, 2012, an illegal billboard advertising the New York Lottery fell onto the Brooklyn-Queens Expressway (BQE) due to high winds. The collapsed billboard blocked the BQE after falling on a guardrail. It also struck a nearby car wash and body shop, severed a gas line, and damaged a vehicle. Fortunately no one was injured, and traffic resumed about an hour after the incident.
The billboard was mounted atop 421 Meeker Avenue, and fell around 2:20PM, with the billboard's metal supporting partially falling on the building itself. Gas at the building was shut off, and the FDNY confirmed a partial gas leak. The New York City Department of Buildings zoning rules prohibit billboard placement within 200 feet of highways, however many City highways are lined with illegal billboards.
"It is time the Buildings Department cracked down on illegal billboards," said Council Member Letitia James. "It is fortunate that no one was hurt in this incident, but it is time the City enforced this rule and held sign companies responsible. As long as advertisers make more in illegal billboard placement than they pay in fines, this will continue to pose a danger. I call upon the Department to inspect City billboards for legality and safety."
In 2009, a Federal District Court in Manhattan found that “the City’s enforcement of its zoning regulations has been inconsistent and less than vigorous...The billboard industry has taken advantage of this lax enforcement and has consistently ignored the regulations on billboard sign location.”

CM James Creates Online Petition In Support of FG Tire Shop
F + S Tires is the Fulton Street business that has been closed by the Department of Buildings due to violations and an issue with the certificate of occupancy.
The owners received more than $24,000 in fines for building violations, such as for improper support beams, lacking a sprinkler system and garbage in the basement. The certificate of occupancy for the building is another major issue. A DOB inspector informed the Joseph brothers that it would cost hundreds of thousands of dollars to obtain a new certificate of occupancy.
The Fulton Area Business Alliance (FAB) and the Pratt Area Community Council (PACC) are assisting F + S Tires, and a Department of Buildings hearing for the violations is scheduled May 16. ATTENTION: Hurricane Earl
Hurricane Earl, which carries steady winds of 135mph and quickly jumped from a Category 1 to a Category 4 hurricane, is set to touch ground in the NYC area on Friday. You have been warned. Although the New York Times blog Cityroom states that the storm won't get "any closer to New York City than 200 miles east-southeast of Far Rockaway". So that's good. ATTENTION: Ryerson Chimney Collapse
Regarding the brick crumbling on 132 Ryerson posted on the NYT Local yesterday, here is the most up-to-date information we have at this time-
132 Ryerson is a privately-owned building. It was evacuated on Sunday (7/26) after significant heavy rains caused brick falling (the building borders, at the rear, 499 Myrtle Avenue, which houses La Stalla restaurant). A violation was issued that day to the owner for not properly maintaining the building. Building will remain closed until contractor completes emergency repairs (should be made within 48 hours). The brick falling was due to the collapse of a "dead chimney" (out-of-use) onto the neighboring restaurant. On Sunday, the DOB Deputy Commissioner was out with representatives of the owner and an engineer examining the building. Additionally, part of neighboring building (with the restaurant) was temporarily evacuated.
Three families were evacuated from 132 Ryerson. The Red Cross has stepped in to deal with families. 132 Ryerson's owner is obtaining an engineer, and putting together a plan to repair building damage. DOB will take further steps to re-inspect building at that point.

Town Hall
Last night, Council Member Letitia James held a Town Hall to address infrastructure in Clinton Hill following the Myrtle Avenue building collapse at St. Luke's Church on Washington Avenue between Willoughby and DeKalb Avs. Representatives from City Agencies were present, and were able to speak about what's happening at this point, as well as how to report structure-damage that is potentially dangerous. There will be additional communication after the appropriate City agencies have completed the necessary investigations into these matters. You can see more on NY1's report here.
Infrastructure in a majority-historic district is always a concern, but we urge people not to be unduly alarmed by these events. Responsibility for the care of property lies with the property owner. We encourage renters to sign legal leases, and attain renters insurance when possible.

We are sending this information to the displaced residents, who can follow-up on the items they are interested in. We have some important info concerning fundraising activities for the Myrtle Avenue displaced residents.
First of all, for all the wonderful residents who emailed us concerning Caitlyn Nunez, we were made aware yesterday that her principal was kind enough to offer to buy her graduation attire. The family is still collecting donations for their additional needs, and again that information can be found here. As spotted on the NYT- Local blog, a local resident noted the various individual fundraising/donation activities planned for displaced residents in the community, so please check that out.
This community has really shown an incredible amount of support towards our neighbors, and we ask that you join our office and community this Sunday:

Update: Building Collapse on Myrtle Avenue
We are saddened to give an unfortunate update on Sunday's building collapse. As of yesterday evening, the residential building next door to the collapsed building- 491 Myrtle- was being demolished floor by floor. Apparently, this demolition continued as of this morning. The Department of Buildings and other City agencies have communicated to local business owners that all businesses on the north side of Myrtle must continue to stay vacated until this process is completed. From what we have been told, residents in most of the buildings on the block have been allowed to return for now.
Update:
As of yesterday evening, Myrtle Avenue from Hall to Emerson will remain closed for 3-4 days as debris is removed.

ATTENTION: Building Collapse on Myrtle Avenue; 6/21
*On June 21, 2009, a four-story building on 493 Myrtle Avenue in Clinton Hill collapsed in the midst of construction around 2:00PM. The building housed Vespers Bar. The few people in the building at the time suffered minor injuries, and all appropriate City agencies responded quickly. Everyone on Myrtle Avenue between Hall and Ryerson Streets were temporarily evacuated following routine precautions, and bus line were re-routed (also temporarily). Council Member Letitia James was also at the scene to survey the damage.
The building had a list of violations on it, including an unrepaired crack running along the side. The collapse damaged a residential building next store, leaving those residents without a home. A young woman, Caitlyn, who is graduating from public school this Thursday was a victim of the collapse, and now needs attire appropriate for her graduation. ATTENTION: Department of Buildings Launches No-Penalty Retaining Wall Inspection Program
The New York City Department of Buildings (DOB) has launched their no-penalty retaining wall inspection program. The Department's inspections are free, and no violations will be issued for the properties being serviced during the No-Penalty Wall Inspection Program.Private property owners with retaining walls are eligible. The program is being implemented throughout March 25- June 1. More information on DOB's inspection programs view here and here.
