City Council Hearings Held on Outdoor ATMs, Development, and Post-Storm Clean-up


On Monday, October 25th, the Council Committee on Transportation held a hearing on Int. 257– 2010, in relation to regulating sidewalk ATMs as revocable consents and requiring safety features for all outdoor ATMs. This bill was introduced by Council Member Diana Reyna. The bill will act as a safety measure (currently there is little regulation or security rules in relation to outdoor ATM machines placed outside of non-banking businesses). The bill would look to address this loophole, and increase safety for consumers. Council Member James also has upcoming legislation regarding outdoor ATM regulation.

On Monday, the Council Committee on Land Use also held an oversight hearing which discussed development on 470 Vanderbilt Avenue.

Finally, the Council Committee on Sanitation and Solid Waste, chaired by Council Member Letitia James, held a joint hearing with the Council's Committee on Parks & Recreation regarding the recent storm.

ATTENTION: BK DA Hynes Establishes Sex Trafficking Unit


The Brooklyn District Attorney Charles Hynes has launched a community outreach campaign aimed at educating the public about sex trafficking and offering help to victims. Sex trafficking exists in Central Brooklyn, and its victims are often girls between the ages of 13-15, and/or undocumented immigrant girls and women. DA Hynes has taken a hard approach against this crime by establishing a Brooklyn Sex Trafficking Unit- or BK STU- to work with victims of sex trafficking.

CM James, Elected Officials, Community Leaders Demand Removal of PCB Chemicals from Schools; 10/26-27

Council Member Letitia James encourages the community to join her, along with State and City representatives to demand action on removing toxic PCB chemicals from public schools

Elected officials, parents, school employees, and activists reach out to a dozen school communities to demand that the Department of Education and the Environmental Protection Agency immediately carry out citywide PCB testing and clean up.

WHAT: PCBs – chemicals which have been proven to pose serious risks to children’s nervous and immune systems and brain development – are currently found in products like window caulk and lighting fixtures in public schools across New York City. Recent results from a pilot study conducted by the NYC Department of Education and the U.S. Environmental Protection Agency found significantly elevated levels of PCBs in two of three schools tested, with levels at the third also above guidances, putting thousands of kids at risk. There is every reason to believe that many schools out of the nearly 700 built or renovated between 1950 and the late 1970s will be similarly contaminated.

This Tuesday, October 26th, elected officials from across the city will join New York Lawyers for the Public Interest, New York Communities for Change, representatives from the UFT, 32BJ, Local 78, other labor organizations, and parents, outside a dozen potentially contaminated NYC public schools as part of a citywide movement to demand that DOE and EPA rid all NYC schools of PCBs. As children file into their classrooms in the morning, parents, teachers, and school employees will all have the opportunity to sign a petition demanding the immediate and comprehensive testing of all schools built or renovated during the time PCBs were used in building materials. A number of schools have also been selected for petitioning during the afternoon dismissal where parents, teachers, and school employees will have the opportunity to sign the petition as children file out of their classrooms.

Zombiefest – a Food Bank For New York City Charity Event

The Food Bank For New York City is partnering with indieScreen to host a charity event to support Food Bank For New York City’s continuous efforts to fight hunger.

During the event, people will be asked to dress as zombies and everyone will “crawl” or walk down Metropolitan Ave., toward indieScreen. After the crowd of zombies arrives at indieScreen, participants will have the option to screen the popular 1968 zombie film, “Night of the Living Dead” in zombie attire. A portion of the ticket price will go toward the Food Bank For New York City. After the film, participants can go to The Cove where the charity event will continue! There will be beer specials and a portion of the proceeds made will also benefit the Food Bank For New York City.

Food Bank For New York City recognizes 27 years as the city's major hunger-relief organization working to end food poverty throughout the five boroughs. As one of the country's largest food banks, their mission is to end hunger in New York City by organizing food, information and support for community survival and dignity.

indieScreen is a brand new theater and entertainment space located on the Southside of Williamsburg, Brooklyn that features a sophisticated A/V room, a restaurant, and a full bar.

BCAP Awarded by President's Committee on the Arts and Humanities; Honored by First Lady

First Lady Michelle Obama Honors Heart of Brooklyn’s BCAP Initiative; One of 15 Youth Programs Awarded Nationwide

First Lady Michelle Obama will recognize Brooklyn Cultural Adventures Program (BCAP), the youth education program that gave rise to the award-winning Heart of Brooklyn cultural partnership, with a prestigious National Arts & Humanities Youth Program Award at a White House ceremony on Wednesday, October 20. Heart of Brooklyn Director Ellen F. Salpeter and BCAP Summer Camp Adventurer Jamell Allen-Thomas will accept the award on behalf of the thousands of children served by BCAP since 1998.

Selected from a pool of more than 400 nominations, BCAP is one of 15 after-school and out-of-school programs across the country to be presented with a 2010 National Arts and Humanities Youth Program Award (formerly, the Coming Up Taller Award- BCAP also was named a 2009 semi-finalist for the Coming Up Taller Award) from Mrs. Obama. The award is the highest honor such programs can receive in the United States. BCAP is one of two New York City-based organizations to be recognized at the ceremony, along with youth media organization Global Action Project.

The National Arts and Humanities Youth Program Awards are administered by the President’s Committee on the Arts and the Humanities (PCAH), in partnership with the National Endowment for the Arts (NEA), the National Endowment for the Humanities (NEH), and the Institute of Museum and Library Services (IMLS). CM James Given "A" Grade on Urban Justice Center- Human Rights Report Card


The Urban Justice Center’s Human Rights Project (HRP) released their 2010 Human Rights Report Card yesterday. The report card grades each of the 51 members of the New York City Council on their human rights record. Council Member James is one of the nine Council Members who received an "A" grade on the report card.

DOE Launches 2010-2011 Elementary School Gifted and Talented Admissions Process


This week, the New York City Department of Education released information for families interested in testing their children for eligibility and possible placement in elementary school Gifted and Talented Programs, kindergarten through third grade, in September 2011. Families interested in having their children participate in the testing – which is required for eligibility to a Gifted and Talented Program – must submit a Request For Testing Form (RFT) by of Wednesday, November 17, 2010.

The Request for Testing Form and the New York City Gifted & Talented Information Handbook 2010-2011 are available to public school students at all public elementary schools, to non-public school students at all Borough Enrollment Offices and to all students at the NYC Department of Education’s website.

The Department of Education will host five borough-wide Parent Information Forums on the Gifted and Talented admissions process. At these sessions, Department staff will present an overview of testing, scoring and placement, and answer questions from families. Each session runs from 6:30 p.m. to 8:00 p.m. The schedule for the Gifted and Talented Parent Information Forum for Brooklyn is as follows:

Crow Hill is situated in the west section of the 77th Precinct, which is currently experiencing a rise in burglaries, and the Crow Hill Community Association believes an establishment that specializes in buying and selling goods will not be beneficial for its neighborhood. Crow Hill is committed to the revitalization of Franklin Avenue, and will use all of its resources towards the goal of improving quality of life and public safety issues. The Crow Hill Community Association is united in opposing any landlord or developer who wishes to bring inappropriate projects to the community.

Regarding MTA Transit Fare Increases

Council Member Letitia James was incredibly disappointed to learn that the MTA decided to approve the transit fare increases. The following is the testimony the Council Member presented at the MTA Public Hearing on September 21, 2010.

"I want to register my strong objection to any increase of the MTA ridership fare and toll modifications proposed for implementation on January 1, 2011.

Under the proposed MTA plan, the cost of an unlimited monthly Metrocard would increase nearly 17%, from $89 to $104. Riders would have the option of opting for a less expensive $99 card with a maximum number of trips limited to 90. The MTA has presented this proposal as progressive, noting the difference in income between riders who purchase the pay-per-ride Metrocards and the unlimited weekly cards, and those who purchase the 30-day pass. I would say that the board has a faulty understanding of wealth when they consider an individual making $63,000 annually in New York City comfortably able to afford a 17% fare hike. The monthly unlimited card has always been the most affordable option on a day-to-day basis; those who use public transportation daily and choose day-to-day or weekly Metrocards are clearly purchasing their cards with the money in their pocket. I agree that the MTA should keep the needs of New York’s working-class citizens primary in their consideration, but a truly progressive increase would not harshly punish the majority of middle-class New Yorkers.

I’ve heard the excuse of the MTA— the state funding is lacking. All New York State and City agencies have felt the crunch. But the reality is that the MTA’s financial picture is what it is because of the bloated and wasteful spending of the agency itself. This is the same agency that sells-off land underpriced to wealthy developers while laying off their municipal workers. New York State Comptroller Thomas DiNapoli reported earlier this year that MTA overtime costs soared 26% between 2005 and 2009, nearly $3M more than anticipated this year alone. MTA overall spending has grown at an average annual rate of 7% during the past five years, more than twice the rate of inflation. The MTA’s outstanding debt totals about $27.5B, 54% higher than it was five years ago. The MTA Real Estate Taxes are coming in short by $105M. The MTA Payroll Mobility Tax will be over $200M short of projected returns by the end of the year. These muddled numbers and others leave you with an $800 million deficit— a deficit that seems to steadily increase. And recently, Moody’s reduced the rating on the MTA’s transportation revenue bonds to A3, the fourth-lowest investment grade.

While you ask the ridership to accept a fare hike, what is being done to improve the MTA’s financial plan? What structural changes are being made to ensure future financial stability? Is there going to be an increase of services in the future, or can we continue to see the drastic service cuts that have taken place in the last 24 months? Are you building upon technical upgrades? It is important that the MTA communicate with the City at large what they plan to do to improve service, instead of lazily pointing to finger at funding issues.

Until I see a concerted effort to change the structure of the MTA, I will stand with the taxpayers and ridership in opposing these fare increases."

ATTENTION: NYC-ECB Makes Appeals Available Online; Develops Info Video


The NYC Environmental Control Board (ECB) is a neutral forum where hearings on tickets issued by 12 different City Agencies are held. ECB is committed to making the administrative hearing process fair and accessible to everyone who wants their day in court, in order to assist you, ECB has:

-Enhanced its website to provide helpful information to the public
-Made free translation services available in every hearing room
-Reduced decision turn-around times to 30 days or fewer
-Created informational materials for the public

Appeals are now available online at www.nyc.gov/ecb. Hard-copy appeals are still available in office, and are available in both English and Spanish. The ECB is also concerned with offering assistance in understanding the appeals process, and have developed a 3 minute informational video. You can view the video on their website at www.nyc.gov/ecb
